I am 21 yrs old and need help filing for bankruptcy. I have no money and a 1 year old son. I am currently unemployed but fiancée is taking care of us right now. Where trying to get married but the creditors told me the are garnishing my income tax.help! If anyone know what I can do so I can start anew I would deeply appreciate it.This is a lesson learned.Dont go into debt and darn those credit cards!

First of course it may depend on how far in debt you are. And the such,

Next of course if they have sued you and have a judgement, they may be able to get a garnish on it. But without a judgement they can't do anything.

Next collection people lie, so don't talk to them on the phone, make them do everything in the mail. Go talk to a bankruptcy attorney and they will tell you your options.

First, its not a good idea to scatter gun questions all over the place. This is at least the third question I've seen from you. All with slightly different questions on the same situation. I suggest you kep to this one thread and give us full info.

Second, for any creditor to attach any assets you have, they have to obtain a judgement first. That means taking you to court. Once they have the judgement they can seize any assets, including income tax refunds (not the tax itself).

Third, if you do want to start over, you need to consult an bankruptcy attorney. But remember that student loan debt is not dischargeable. If that represents a large chunk of your debt it might not be practical to file.
