View Full Version : Third party check being cashed at issuing bank with a garnishment against account.

I pulled some money, $5000.00, out of my 401k plan because I was laid off and need some money to pay bills. I had a bank garnishment enforced which over drew my bank account. I never contacted the bank and consiquently the account was closed and I have another creditor on my back. Unfortunately the $5000.00 check was written on the bank I have the garnishment with. My question is if I go into a branch and try and cash the check will the bank have authority to keep my check? I would just endorse my check with my signature and I am sure I would have to provide my drivers license but is there any way by running my name and drivers license would it show in there system. I really need this money as the initial garnishment that started this whole mess is one of the bills I need to pay.

I am a little confused if you drew the $5000 out of your IRA why didn't you cash it then and there when you withdrew it? Did you hold the check? Bad idea to ignore a bank garnishment.I know nothing about banking but I would quess they would question it, maybe some one with knowledge of things like this can better advise you
