Hello
My situation so confusing. I am F-1 student and my husband is a US citizen. He took my name after the marriage (8/15/09) and his new name is listed on the marriage certificate, however, he has not yet started using his new name. All his documents are in his old name. Now we are filing I-130 for me. Should he use his old name(the name he still uses) or the name on the marriage certificate?

I would appreciate any help

Did he go to court and legally change his name? That is the important thing. He can only use his legal name and it has to be obtained through the court system of the state he is a resident
When you have a court change your name, then you are suppose to change all legal documents, drivers license etc to that name. For instance, when a US citizen (woman) gets married, she is required to notify the SS and get name changed and on driver's license. Hope this helps :)

Thanks for the quick response. No he didn't go to court. Now I suppose we would just use his current name and he can change his name later. I suppose there is a certain time frame after the marriage that he can still use his "old" name?
