View Full Version : Lawsuit with Creditor and Bankruptcy

I have been in the process of filing for bankruptcy (educating myself,) when I was served a lawsuit from a credit card company for $2,000. I was able to get the Bankruptcy papers filed 2 days before the court date for the lawsuit. Do I still need to go to court for the lawsuit? And if I do need to go, should I accept or deny the charges? I have copies of the Bankruptcy papers that I can bring in if needed. Thank you

You must appear if you were served. You must have had other notices prior to the summons, did you ask them to prove the debt was valid? How long ago was the last payment made or card used?

I have a similar case. Should I get an attorney to write the letter of response or can I do it myself? And if so, what should I include in the response? The last payment I made was this week, I had pre-arranged monthly payments of 150, after not paying for a while so I don't know why I received the summons I thought there was an arrangement already made.
