View Full Version : Working for Congress, State Tax Jurisdiction

I work for a California Congressional Office, but live most of my time in DC for the last couple of years, though I go back and forth often. Can I pay CA state taxes (vs. DC) if my only income is through a congressional office, I vote in California and call that my "home"??

“Your tax home is the general area of your main place of business, employment, or post of duty, regardless of where you maintain your family home. Your tax home is the place where you are permanently or indefinitely engaged to work as an employee or self employed individual. Having a "tax home" in a given location does not necessarily mean that the given location is your residence or domicile for tax purposes.”

DC only taxes those person who LIVE in DC; those who work in DC only are exempt from DC taxes.

That said, you are probably considered to be a DC resident due to living there for most of the year. You are also considered to be a California resident and this liable for California state income taxes.

However, California WILL give you a credit for the taxes you pay to DC so that are NOT double-taxed.

Did you file DC tax return for 2008 or 2007?
