Just wondering what a judge may do on a first time felony probation violation? My boyfriend was suppose to have 33 days in jail or 240 hours of community service completed by August 1st, 2009, also did not keep in contact with probation agent & did not complete a psycological evaluation. His probation had been transferred to another county where he had been in contact on a regular basis with his probation agent so he was just a bit confused as to why he was being violated in the other county. Just wondering if you think the judge will make him sit his jail time & if he will be sentanced longer or if the judge will give him the option to do community service again? We are getting married in October & it sure would suck if he was in jail on our wedding day.

From what you say, he DIDN'T violate probation, and if I were him, I'd SAY SO, and I'd say it LOUDLY. Clearly, if his probation was transferred, he HAS a probation officer in the new country, who can clear this up and get him out of jail... Why don't you call him up and ask him to intervene?

If he failed to perform 240 hours of community service by August 1st and didn't - then indeed he did violate his probation. Not keeping in contact with the PO and not completing a psychological evaluation is another violation. He is going to have to go to his violation of probation hearing and explain to the Judge why he didn't complete the 240 hours of community service and have the psychological evaluation performed. Possibly the judge may decide to park him in jail for the 33 days as your boyfriend does not know how to properly complete anything. I highly doubt he will be given more probation to let him complete the community service or get the evaluation. But then, no one will know the outcome until the Judge decides.
