Hi ,

I am sakum from INDIA.

I came to US and working for a client in US on L1. Base company is in INDIA .have many locations here in US.

I came on 6rd July 2009. Federal, SSNtax,State,etc taxes are deducted from my salary paycheck.

I am married but my wife has not joined me yet. I may stay for next 1year
I am planning to get my wife , but not sure.

My Questions:

1) By Dec 2009 end of fiscal year - I will not finish 183 days. Will there be any difference in returns?

2) If my wife didn't come to US - Can I claim as Married status?

3) If my wife joins me after Dec 31 2009 - Can I claim as married ?

3) If I claim as Married status - will I get more returns?

4) I am paying around 10000 tax for 6 months - how much I may get as 1)single 2) Married.

1. You have two choices
(a)You can file nonresident tax return, or
(b) You can file joint return as married filing jointly. Wait to file your tax return after you complete SPT in 2009. Your U.S. Tax Return: Substantial Presence Test (http://taxipay.blogspot.com/2008/04/substantial-presence-test.html)

3. You can file joint return even when your spouse has never been to the U.S.
4. You need to do it yourself -- as nonresident and as a joint return.

On the joint return, you must both report worldwide income for 2009. It you paid any taxes in foreign country, then you can claim foreign tax credit.
