I am a father of three children and in 2003 my ex-wife and I gave temporary custody of our children to her mother. AT the time I was handed the divorce papers I was in jail for bad checks( young stupid mistake). I agreed to it because Amy the ex and her mother had talked and it was best. Deana the grandma want let the kids have overnight visits with myself or Amy (always a different excuse). My main concern right now is that my 9 yr old daughter has been having seizures and I believe the granny has been giving her to many pills in order to get a disability check on her. I pay child support to her weekly and she gets this check. She is 60 yrs old and keeps a nasty house with roach bugs crawling all over the place. Carl is the granny's boyfriend that just passed away and would never have me coming over to visit my kids, there have been several occasions that he and I had confrontation. Last week Deana could not do anything with my 9 yr old daughter and called the police on her because she couldn't make her mind. Monday she called the ambulance on her and had her admitted to the Birmingham Hospital because of her behavior. They put her in a strait jacket for the first couple of days and the child went to Birmingham by herself in a ambulance and the granny did not make it up there till the next day. Can you imagine how scared she was. I believe that she is unhappy and this is her way of showing everybody how much this has built up in her. I think she was scared of Carl and now that he is gone she feels like she can shout out to the world how much she is hurting. Several months ago Amy tried to get custody of the kids but she had a legal aid attorney and Deana had a $4000 lawyer. There is a caseworker that lives next door to her that she is real good friends with and when the law was called she came over and did nothing but try to calm my daughter down. She called Birmingham Hospital yesterday to get her remitted because she wouldn't mind again. We went to there house last night and begged and pleaded with the granny to let her come to my or Amy's house to see if we could help with the situation. We told her please let us try before she sent her off again. We have no say what do I do? I pay child support do I not have the right on the medical decisions for my child and Do I not have the right to see my child? She only has tempory Custody. What is your advise because we feel helpless. My child thinks we have deserted her and you can't explin to a child that is hurt and confused that you have to listen to the courts. Like I said we firmly believe the granny is giving her too much mediation and she is even trying to get my 8 yr old son on a check for learning to slowly. She can have the money just let us have our kids before they fall through the cracks and end up hurt or no telling what. Thanks Looking forward to your reply.

My advice is to get an attorney and file for full custody.

Then brush up and file on your own. If your child is in that much trouble then you need to do something. Another thing is talk to her doctor about the meds. If she is getting too much then the doctor should have a record of it because to get it there has to be a perscription. If there are roachs running around call CPS and ask what are the guidelines. Keep pushing to get your kids back. She too could be having mental problems from stress and forgetting things is one of the symptoms. So it would be easy to over medicate.

I agree with Scott.. file the papers.

Then give it up. I know that sounds harsh, but you can't afford NOT to have an attorney. You already saw what happens when you go up against an attorney with a substandard one, how do you think you will fare going it alone? If you really want to get the kids back, you need to fight fire with fire.
