View Full Version : How to take an unfit father out of my baby's life legally?

That guy does porn movies, doesn't work "legally'', n now I just find out that he is selling drugs ( I recorded him saying that but I think that is a good prove) Also he has guns.

My baby is 5 months old, and we are not married.

So, would like to know if I can do that legally?

Sure!

Get a lawyer, PROVE him unfit, and go from there to get full legal and physical custody.

Depending on your state, you may not be able to take away parental rights from him unless you have someone (usually a spouse that you've been married to for at least a year) to adopt the child.

Go after him for child support. He should be paying for his kid, not the taxpayers.

Have you gone to court yet for custody and child support? You can try to get full custody. If you can prove all that you have said here I can't imagine a judge would allow him more than supervised visitation, although there's never any guarantee for what will happen in court. Has paternity even been established yet?

He is in the birth certificate. But I haven't filed for anything.

That's what you need to do. And I agree with synnen, having a lawyer help you is very important. It's going to take more than just you saying something is true to make the judge believe it. Has he expressed any interest in being in the child's life? Or has he mostly been staying away already?

I suppose all of this transpired within the last year?
You fathered a child with this person, he wasn't too unfit to sleep with.
Just keep documenting and contact an attorney.

Let see - in this country doing porn movies and owning guns are not illegal. Define working legally? That doesn't make him unfit. Selling drugs... unless he gets busted for it, good luck proving it.

Sorry... but it doesn't look like you have much of a case.

Hm. Reading steve's comment is making me think about this more. My mind automatically jumped to owning illegal guns and running a shady under the table business with the drugs. But steve is right. Porn usually isn't illegal. And so long as he's following gun laws, neither is owning a gun. Selling drugs is the only definite illegal thing that seems to be going on. And that can be hard to prove.
