View Full Version : Finding out if I am still listed on the deed.

I am currently divorced, but my ex-husband claims that he never removed me from the deed to the house. He is currently sitting in jail and looking at possibly being deported. What I am trying to find out is What happens to the home if I am in fact still listed on the deed to the house and he is deported? I tried contacting the mortgage company and all they could tell me is that I am not on the note, therefore I am not responsible for the loan and that I should contact a real estate attorney. Aside from me still possibly being on the deed to the house, I am also considered his sponsor because he is an immigrant from Jamaica. What do I do?? :confused:

Contact the town clerk in the town the house is located in. He should be able to tell you if you are still on the deed.

I actually did this by going to the website for the County Courthouse and found out that I am still in fact on the deed. Now I don't know what to do though. I am not responsible for the loan, but I am on the deed... what does this mean??

You are not responsible for the loan but if no one pays the note your home may be foreclosed , so start thinking of paying the mortgage.

Typically what it means is that you own 50% of the equity of the home. If it is foreclosed, you get half of whatever is left after all the fees and such. Or in other words... it probably means nothing unless there was a lot of equity.

Im sure not going to pay off the loan when his wife is living in the home!! If Im going to pay on the loan I am going to be the one living in the house.

I wouldn't pay it either. Technically you don't have to do anything. You are not liable for the debt. There is a chance you might get some money out of it... particularly if they sell before foreclosure. The house cannot be sold without you.
