View Full Version : Relocation to a different stae during a custody trail

My daughter lives in Staten Island New York she is unmarried and had a child 11 months ago , the father of the child left them 5 months ago and she and the child are about to be evicted she is unemployed has no source of child care to get a job, I live in Georgia and have a 3 bedroom house to provide them with shelter and child care the father of the child is now going for joint custody and has missed 3 weeks of child support he does not want the child to relocate to our home in Georgia he stated this to the court and they told her that the child could not relocate until the trail has been determine, is there any thing I can do to convince the Judge that she and the child will be in a shelter there are no other family members to help them.

Until the judge grants a Petition for Right of Removal, the child will need to stay within the jurisdiction boundaries until custody has been determined at a trial. Does your daughter have an attorney? Does the child have an advocate?

She has a legal aid attorney, it can take a long time for the petition what happens when they are evicted I am worried sick/

All she can do is tell her attorney. Allowing her to move would hinder and visitation schedule and they are fighting for joint custody. Until a trial is held the judge can not determine the child's best interest. It would be easier for you to move to her.
