View Full Version : Evicting a preson in my apartment not on lease and not paying rent.

Hello, I have a tenant living with me that has stayed here for abut 3 months, this tenant is not on lease, has never pay a penny in rent. The landlord know he stays here. Its not OK with the landlord he wants to charge me more for the extra tenant.
This tenant also bring drugs into my apartment and I have ask he not to.

What steps can I take to have him removed with out calling the cops about the drugs because I am on probation. I what him evicted but I do not want my probation officer to know that he had drugs in the apartment. What steps do I take do get him out of here after three months, his mail does not come here, but I was told that if I invited him in after this long that there is a law allowing him to stay. Is there anything I can do?

The problem here is this person can establish residency. Therefore he has to be evicted according to your local laws. If there was an agreement that he contribute to the rent, but he hasn't, then you can give him a pay or quit notice (of 3-10 days depending on local rules). Otherwise he is a month to month tenant and has to be given at least 30 days notice to vacate.

Go to your local housing court to determine the correct process for your area.

What Scott said is absolutely correct...

But, you have another issue at work here - drugs and probation...

So, if it were me, I'd move the guy out and change the locks. It's true - it's an ILLEGAL eviction. But that's a civil matter, and I doubt that he'll sue you in any case. However, leaving him in your living room with DRUGS is a PRISON sentence for you... So, I'd take the course that provides the LEAST resistance.
