I have been separeted from my husband for 11 months now. We still don't have divorce papers and we have not filed legal separation. I would like advice as to how to file for taxes. We have 3 children. I am head of household. Would it be wise to file separately and have him claim 1 child?

If you maintain your separation, you WILL be able to file HoH for 2009.

For 1008, you can file jointly or separately. Ultimately, you need to coordinate this with your husband to determine how HE intends to file and how many children he should claim.

Ideally, you should BOTH use the same tax consultant so she/he can model the return to determine which filing status serves everyone best.
