Hi, for the past three months I have had many problems with the apartment I am renting out of. The first thing I noticed was when it rained, the rain came through the ceiling and was dripping all in my room. There is this hole beside my bed where the rain came in and also weird bugs like centipedes came out of. There have been cockroach spottings and recently we learned that we have mice! (or rats I'm not sure).. they put poison down but I still am scared to sleep at night and I moved out of my place and into my friends apartment which is a lot nicer. I am trying to get out of my lease now because subletting is not getting anywhere. I have asthma, and have seen mildew on places in my walls. (and I am in fact allergic to that). To be honest I haven't had any asthma attacks, but I need to get out of my lease and was wondering if you think I had a doctors note it could be substantial enough to get me out of the lease? I have until October 1st until I have to start paying the new rent. I don't want to be stuck with 2 rents! I can't live at my old place it is too scary for me. Please help!

Hello NY:

If your old apartment was uninhabitable and/or your landlord didn't address your complaints, and if you had documented all the above, you MIGHT have been able to get out of your lease...

But, it sounds like you just don't want to live there anymore. A doctors note ain't going to do anything...

You're best bet is to negotiate a buy out of your lease. Your landlord might let you out if you give him two months rent or so... Otherwise, you could be held liable for the ENTIRE lease if he sues you.
