View Full Version : Can I work on 1099 on OPT

Hi,

I am an International Graduate of May 2009.
I just started my opt on 2nd July 2009 and I worked for a company as Post Opt Unpaid Internship. Now the company is planning to hire me as Contractor on 1099.
So I don't know what is exactly 1099 is ?
Am I eligible to work on 1099 in my OPT period?
If not then what are the other options I can put forward to my Employer.
The other information which he provided is my Tax will not be with hold.
So how does this prove that I am working for some one in order to avoid my unemployment days on opt.
I would highly appreciate help.

1099 is a taxation status from the employer perspective. It is a "self-employed" status for IRS tax filing purposes. The employer will not withhold or pay taxes, you do it on your own, generally as an "independent contractor". Good luck.

Thanks for clarifying my perspective with respect to TAX.
But I am more conecerned here in the status on which I work on 1099 is OPT is a valid status or not.

Yes, you can work and be paid as a 1099 contractor with your OPT EAD.
