View Full Version : Charged with criminal tresspass 2nd degree

Hi Everyone, I was ran off a county road in 04' with my husband in the (passenger seat) and my mother and son in the rear, by a pick up truck pulling a trailer with a man and a dog sitting on the trailer. After being run off the road, I then followed the truck @ quarter mile down a multi family private gravel road not a single residence private road, long enough to get the plate # so I could call the police. I went straight to the nearest neighbors house and requested them to call the police. My husband filled out the complaint form, then the officer went and spoke to the other party, came back to us and stated that they were filling out a complaint for tresspass. The neighbors even stated to the officer that we had been run off the road and hadn't tresspassed at all. Next thing we get is a letter that my husband was being charged with 2nd degree criminal tresspass. And Nothing was going to be done to those that ran my fanily off the road! He spoke to the . Pros. Attorney which told him the only thing he could do was plead guilty, that he would not win this. My husband left, they eventually issued a warrant, which brings us to date.. we just went to court with a (lawyer) to which my husbands options are: Pay 300$ keep the very false charge on his record, my husband is 52yrs old with never having been in trouble and VERY PROUD of that fact, Take 2 yrs probation, or Take it to trial, starting at 1000.$ which she stated from their attitudes and writings in the file (NO DEALS) that he would not win and would be looking at a year in jail plus fines. @ a year ago we were told that the other party wanted this dropped, however the state will not drop the case.This road has a 30' road easment to which we never left, there was no destruction of property or to the gravel road etc, and he was the Passenger of the vehicle never getting out of the vehicle even. I'm not sure what to do ,as I am not rich to fight a false charge that even the other party wanted dropped! And even more upsetting is that they go after my husband and do nothing to them for running my family off the road! Thank You for any and all help! xbassiex

Were they any signs erected along side the roadway stating that this was private property at the time of the incident?

There were no signs on road or property.

Hello x:

Tell you hubby to plead NOT guilty, and NOT to talk to the prosecutor again... He should be given a lawyer at his first hearing...

I HATE cops.
