I am an Indian citizen and I am currently in USA on OPT (F1 student visa). I am in USa since Sep 2006 and I am here along with my wife and she does not work here (dependent on me). I am going to have a gross salary package of 85000 in my new job. This would be in the state if Maryland and I assume that I can claim a std deduction of 5350 (US-Indian tax treaty) and 6800 of exemptions (being a married person). Now here are my questions:

1) What is my tax filing status (Non-resident or a resident alien)?
2) What is my taxable income?
3) How much Federal tax do I owe?

Any answers would be highly appreciable.

Thanks
Gaurav

1. You must file nonresident tax return Form 1040NR or 1040NR-EZ and Form 8843. You can not file joint return.
2. You will get standard deduction (instead of itemized deduction) of $5,350, and two exemptions of $3500 each (if your spouse did not have any income).
