View Full Version : Vehicle damage due to avoiding cyclist.

While driving today I narrowly missed a girl on a bicycle who was about to cross my path by swerving toward the curb and locking my brakes. This was in the middle of the block and she wasn't paying a lick of attention until she heard the squeal of brakes. No doubt about who's error this was. My first thought was thank god I was able to avoid hitting this little girl. My second thought, who bites the bullet on vehicle damage if I were to have nailed the curb. Would I have had grounds to recover the cost of repair from the girls parents?

If you could prove that the cyclist cut you off causing you incur damage to avoid her, you would have a case. You could sue the parents.

However, without witneses, proving your case would be difficult.

Well in this particular instance the road was a fairly busy one with traffic meeting me head on and a woman driving right behind me. I don't think witnesses would have been an issue.
