My husband and I married in January 2009, I had a house, he had a house. He was letting his daughter and her fiance' live with him until he finished school, they were paying $200 month rent but there was nothing but a verbal agreement. In the meantime, we refinanced his house and paid mine off so now his resident is in both our names. In July the daughter and her fiance' broke up and he moved out. We told the daughter that she would have to find somewhere else to live now that the engagement was over. We want to sell both houses and buy a new one. This was discussed with her on two previous occasions. Last week when we went by to get something that we had left there, she has moved one of her friends and her baby in with her. My husband has confronted her and told her the friend would have to go immediately and told her once again she would have to move. She did deposit her 200.00 into my husbands saving account for August, but now she won't answer her phone.
We have tried to be very patient with her but don't know how to get them out of our house. It is our property and there is no rentalal agreement, what should we do..
My husband sent them both a text message today telling the friend she will have to be out by the 30th of this month, if she isn't we will come over and move her stuff out to the side of the street. Can we do this? If it is our house can the authorities punish us? We worry about liability with the friend and her baby living there?
