Hi, I was given the right to sue by the federal gov against the state since I am a state employee. It is a very very sensitive civil issue but my problem is the AG who represent my job is trying to motion to dismiss based on state soventry and the eleventh amendment I live in PA and work in NY. i have lived in new york all my life except the last seven years. I commute to work in NY and have a p.o. box address in NY. I find that there are not many lawyers in ny that wants to go against the AG.
Is there any strengh in the AG motion, as far as these state laws are concern? They have written tell the judge he/she has no jurisdiction. Is this true?
I really need a lawyer but financially its not easy, and I sense their fear, the AG cannot let my case go forward it would be very embarrassing for high profilers in NY. What can I do?
