I am a homeowner that had to declare chapter 13 bankruptcy two years ago after losing my job of 10 years. I am current on my mortgage payments. It is becoming difficult to pay for my mortgage and the chapter 13 trustee. I contacted my lender and because I am in chapter 13 I must get permission to refinance. This will cost me $1000 just to have the paperwork filed with the court.

How can I afford to ask permission when I am having money problems now? I am currently employed but I had to take a $17K salary cut. My husband is on social security benefits but it is a very small amount that he receives monthly.

Is there any way that I can get help without having to put out money that I don’t have? Any suggestions would be greatly appreciated!

$1,000 is what your attorney is asking to do the work?

Yes, outrageous isn't it?

You can find another Attorney. I see no other way around this.

Or do the paperwork yourself but I don't see that being successful.

Is he asking for that $1,000 as an additional retainer (advance against fees)? If so, will he bill you by the hour?

That's the total amount.
