Hi All,
I was in US-CA from 10 May09 to 07 June09 on L1B Work permit.. I need to file my IT Returns for this duration as my employer has deducted almost 1500$ as tax.. Please let me know
1. when can I file the Income Tax returns?
2. which form will be applicable for me?
3. what's the last date to apply for IT returns?
4. Is there any online tool(free) which can help me filing my taxes?

Guide me in all these issues...
Thanks..
Rajesh..

Rajesh:

You will need to file a non-resident alien tax return (Form 1040NR, probably with Form 2106 to claim daily living expenses).

The earliest you can file is late December, because the IRS will reject any 2009 tax return they receive prior to 1 January 2010.

Form 1040NR MUST be mailed; it cannot be filed on-line.

Due to your L-1B visa, you ARE liable for FICA taxes, which will NOT be refunded.

Yes, you will file nonresidnet tax return. The due date is April 15, 2010. Earliest you can file is in the second week of Jan 2010.

You may be able to deduct your ordinary and necessary travel expenses while you are temporarily performing personal services in the United States. Travel expenses include transportation, lodging and meals. Use Form 2106 or 2106-EZ to figure your allowable expenses that you claim on line 9 of Schedule A (Form 1040NR).
