View Full Version : What will happen at court for a felony VOP?

My boyfriend is in jail for Violation of Probation, because he never initially checked in when he was put on probation. The original charge was a drug felony charge and he plead out in court to pay $20,000 by a certain time. He only paid $10,000 and that is why they put him on probation... he never checked in, that is when they issued a warrant. What will happen when he goes to court? Will he have to do time or be put back on probation or..

It'll be up to the judge ; there's no way to predict for sure. He may want to consult an attorney to see if your state mandates any particular action in such a situation.

Most likely he will go to jail. He has already proven that he cannot obey the rules of his probation, so he would be considered a risk to put back on probation. In many places, I don't know where you live, he is very lucky to be put on probation for a felony drug charge in the first place.

I hired him a lawyer for $5000 almost 3 weeks ago, but the lawyer has not gotten back to me at all about it.

The attorney is not going to get back to you. The attorney will be allowed to communicate with him and him only. It's called attorney/client privilege.

Of course I guess this is where I always have some "issue" they can find 5000 for a lawyer, but could not pay the other 10,000 for the fines.

But my guess will be at least some jail time but it will be completely up to the judge.
