I filed the federal return as a resident alien under Substantial Presence Test. I am on H-1 visa. I do understand that I need to file form 1NPR for Wisconsin state.
In 1NPR form instruction Pg 23 explanation of Line 36b states " If for federal tax purposes you are a dual-status or nonresident alien for 2007, check line 36b and fill in 0 on line 36c. You can’t claim a standard deduction. EXECPTION: If, at the end of 2007, one spouse was a nonresident alien or a dual-status alien and the other spouse was a U.S. citizen or a resident alien and you qualify to file a joint return (as explained in the Exception on page 7), do not check line 36b. Complete line 36c."
As for federal tax purpose I am a resident alien so am I eligible to claim standard deduction for Wisconsin state return?
