View Full Version : Can I fire myreal estate agent?

About four months ago I hired this realtor to sale my house in a short sale transaction, she told me that she was an expert on short sales and decided to give her the listing. I’ve never heard from her in two months but decided to wait a bit more. Two weeks later I decide to call her. She told me that not one show up to see the house and that she was getting a little anxious about it. I told her about a friend of mine who may be interest in the house and to please give him a call. I called my friend a week later but he was not all that clear on the short sales process. He told me that my realtor was very vague on her answers and did not know anything about short sales as this was her first short sale transaction. I was shocked since a week later he was very enthusiastic about buying my house. One day my sister told me that she knew an excellent realtor (why I didn’t talk to her before?) that only worked on short sales properties and decided to call him. He was very surprise that my house in four months did not get one possible customer but did not elaborate on that. I called my other realtor and told her about this new realtor that my sister had refer me to, she told me that if wanted him to represent me that it would not be a problem, all I had to do was to let her know and that she would take the listing out of the MLS, I did! She took the listing out of the MLS waited about a week called this new realtor and gave him the listing.
In the first week he had the listing, three people look at the house. I then told him to call my friend and gave him the status of what had happen in the past with my other realtor. Later on that afternoon my friend called me and he was very excited about the two hours conversation he and Sergio (my new realtor) had and that he was ready to make an offer on the house. He went on to tell me that this guy really knew his stuff and explained in details the process.
A week later I got a phone call from my other realtor (the old one) yelling, threatening, and calling me a back stabber that if I did not give her the 6% commission on that sale I would get into a major law sue by her broker that she as an attorney was going to take this case personally and that I was going to regret it. I was very shocked at her behavior and did not want to get involved in a lawsuit etc. I calmed her down and told her that I was going to talk to my new realtor to see if they could split the commission. Sergio told me that it was OK with him but to talk to my friend to see if he wanted my old realtor to represent him on this transaction . My friend told me that he didn’t want the other realtor involved because he did not feel she took her time to explain anything but I am sure their personalities did not match. Now I am getting nasty voice mails from her, lots of emails, and I don’t know what else to do. She has the listing for two of my rental properties but I am afraid if I fire her she may retaliate even worse.
What can I possible do to get rid of her?
I did sign a year contract with her broker for the two rentals and the short sale. She had the rentals for almost a year and nothing. The short sale she had for about 5 months. Please help.

If you signed a contract for the listing and you had another broker list it then yes, you can be sued for the 6%. You violated the contract with the original listing agent.

Thanks for your answer. I sent her an email canceling the contract she then took the listing out of the MLS.
