View Full Version : Evict tenant who's name is on Title

My girlfriend and I bought a home in Florida and put both our names on the Title. The mortgage is in MY name only. We split up with the promise that she would get a mortgage in her name in 6 months (advice she was given by mortgage company). It has been two years, the economy tanked, and she has still not gotten a mortgage in her name. In this time she has neglected to pay the mortgage and I have paid to save my credit. Presently she has not paid up to $18,000.00. How do I get out from under this? We signed no lease. Realtors say I cannot sell without her signature. Can I evict her without a lease? I am considering foreclose even though it will destroy my credit.

If she is on the title, there doesn't need to be a lease since she owns the house equally to you. The mortgage and the title have little to do with each other.

You need her signature to sell the house. You could possibly have her signature forced, but you will need to seek a real estate lawyer for that since it is not an easy process.
