View Full Version : Notice knowingly sent to wrong address by law firm

I had a judgement put against me in March 2008 in the state of Missouri. I called the firm handling the judgement and gave them my NEW address where ALL paper work concerning the payments were sent. I made all payments on time up until March 2009 I had that payment deferred for a week until the funds were in my checking account. After that payment I never received any notices about any other payments so I assumed the debt was paid.. I was wrong. They have seized my bank account (which I understand they can do.) but they sent the garnishment notice to my old address in June. I also received a notice today at the old address from the Sheriff notifying me of the garnishment (two days after it happened). My questions are; Can I do anything about them knowing sending this notice to the wrong address giving me no time to respond? And How far apart where the letters from the firm and the Sheriff supposed to be? (They were almost two months)

Why didn't you fill out a change of address form when you moved? Wouldn't you have at least called after a month of not hearing anything from them? Didn't you keep track of the balance you owed and how much you have paid? If I knew that I had a judgement against me, I would make sure that I was up to date on everything and haf my ducks in a row.

I am not sure about your other questions.
