Hi,
Does anyone know the renters law ot statue with regards to how frequently carpet must be replaced in a rented apartment?

In my state normal wear and tear is considered 5 years.

I haven't found a landlord/tenant law that says specifically. In fact, I've never found a law that prevents a landlord from renting an apartment with a WORN OUT carpet.

Problem is that they rent out the place with the worn out carpet and then try to pin it on you when you move out and deduct it from your security deposit if you haven't taken pictures.
That is why I was glad I found the 5 yr wear and tear thing.

Some places policy is to get new carpeting every so often but many landlords will leave it until they absolutely have to replace it.
If you don't make an issue of it most likely they won't do anything no matter how many years.

As excon pointed out, laws are not often written that finely. Another point is, whenever you ask about laws, you NEED to specify your location. Laws are NOT universal. Especially laws that go into fine detail, they are usually local. So what good would telling you the law in NY do if you live in Kansas? I'm sorry, but I really find it hard to understand why people ask questions about laws without indicating a general location (getting down off soapbox).

Finally, why are you asking? Are you a landlord who wants to squeeze a little more time out of the carpet? Or are you a renter who thinks your carpet should be replaced?
