View Full Version : Getting custody of Nephew-mother has no parental rights

My mother currently has custody of my 4yr old nephew and can not longer take care of him. Me and my husband are willing to take him in and even want to adopt him eventually. My mother is in agreement with this. How would we go about transferring custody of him. By the way he has no father listed on his birth certificate and his mom does not know who is the dad. His mother also does not want him and is unfit anyway.

I believe that you will have to get a lawyer.

I have read in other threads that you have to establish paternity for the father before an adoption can go through to get rights relinquished or signed over, but if you don't know who the father is, there has to be a way around that.

I do believe that you will need to have a lawyer for an adoption to go through. Maybe some one who knows more about the legal aspects will come through and give you some advice. Good luck!
