Hi,

I came to USA on 19 Jan 09 and will be going back to India on 28 Aug 09. I have paid taxes to Indian government on my Indian salary during the month of Jan, Feb and Mar 09. I have also paid taxes to US government for Jan, Feb and Mar 09 on my US salary. Note my US salary includes Indian Salary + Allowance. Let me know to which government, I can calim for refund for double taxation in the month of Jan, Feb and Mar 09.


Also what about the taxes paid for the Apr - Aug 09. To which government I can claim the refund due to double taxation in these months.

I will be completing more than 182 days in USA during the year Jan 09 till Dec 09.
Also I was there for more than 182 days in india during the yar Apr 08 till Mar 09.

Help.

You are present in the U.S. from 19 Jan 09 to 28 Aug 09. Any income earned during this period is taxable in the U.S. You will not get any double taxation relief on your U.S. return.
You can claim travel expenses -- travel expenses include transportation, lodging and meals. Use Form 2106 or 2106-EZ to figure your allowable expenses that you claim on your tax return.

Since I have paid taxes to Indian government on the Indian salary portion of my US salary. Do I need to claim for refund to Indian government ( for Jan-Mar 09)?

To be put it simply, I have paid income tax on my indian salary to Indian and US government. So which govt I should be asking the refund for income tax.

If you stay in the U.S. for the rest of 2009, the onward into 2010, you can claim a Foreign Tax Credit (Form 1116) for the taxes paid to India on income also taxed by the U.S.
