View Full Version : Ex-Wife and Child Support Issue

My husband's exwife has been trying to get my husband to pay more child support after my husband a year ago filed a petition to modify child support. In this economy and him being in the construction business, his business has gone down 70%. But according to her he should be the only one in this country that is not affected by the recession. I married my husband a year ago and lost my job, was out of work for several months. I have now been working for a month and not making nearly was I was accustomed to. Her attorney has subpoenaed me at my office for deposition. I set a motion for protective order because they wanted information from before I was married to him. The judge said absolutely not. I went to depo yesterday and he continued to ask me questions from before my marriage. Finally when I refused to answer those questions he canceled the deposition. How is it that they can harass me when A) that child is not mine? B) I just began to work again? C) I have full custody of my child from a previous marriage and D) my income has nothing to do with their Child Support. Please help.

Sometimes a spouse's income is considered because there are fathers and mothers out there who are content with "living off their spouse", so to speak, just to state that they have no personal income and can't pay a reasonable amount of child support for their child(ren) from a previous relationship.
What state are you in? How much is your husband currently paying in support?

I live in Florida. My husband currently pays $609. A month. However, reality is that I just began to work a month ago so he can't be living out of my salary.
