We sold our home on contract, the buyer reneged, and now we find ourselves on a potential foreclosure. The "buyer" was responsible for paying association dues, which of course, he did not. We are asking the Bank if they will take a deed in lieu, however, the HOA put a lien for the dues. They informed us that until this is clear they will not authorize a deed in lieu. Question is: If we pay the HOA to the HOA, are they responsible to clear the lien, can we just pay them, get a receipt and us go to courthouse to clear the lien? We don't have much time before it goes into the sale date. HELP!
