I am going through a divorce in Florida right now, we are not legally divorced yet but he already has a new girlfriend and they are moving in together soon. We have a 2 year old and I don't want my child around him and his girlfriend. They go out and party a ot and they smoke pot. I don't think they are good influences on my chil and I want sole custody, do you think that a judge would grant me full custoy, and what do I need to do to make that happen!!

Hello Watergirl. Sure sorry to hear about your situation. My recommendation would be to run, not walk, to the nearest competent child custody attorney in your town. Most will usually offer a free first consult to determine what the situation is and the potential solutions. And showing your soon to be "ex" that you're serious, right up front, might convince him to make the right decisions without a lot of legal beagles cashing in.

The answer to this question lies in your ex and what he wants. If he wants joint legal custody there is very little hope of him not getting it. If he wants visitation, again, very little hope of him not getting it.

If he wants physical custody... that is much less likely.

On the flip side, there is no chance you don't get child support.

A lawyer increases all odds noted, but again, if he is serious about his child, all the lawyers in the world will likely not prevent him from being in the child's life.

If you don't even want him to have visits, forget it, unless you prove he is a danger to the child, that just won't happen, and even as a danger he is likely to get supervised visits (maybe)

If he wants joint custody, again he may have a chance.

He moving in with another girl has no bearing on this at all. His having a social life, has no bearing as long as the child is properly taken care of when he has the child
