View Full Version : Paternal Rights - Fraud by Mother and Child Support

Former girlfriend used stolen ejaculate from a waste basket to inseminate herself and create a pregnancy. At the time of conception, it had been over two years since we engaged in sexual contact. My requests for an abortion have been denied.
Child support is now being requested. How can I avoid paying child support? Maryland law is most applicable and I desire no rights to the child.

Can you prove that she took the used condom, froze it for two years, thawed it out and inseminated herself? If not you're out of luck in the support department.

Sounds like BS to us and will sound like BS to the court. This is real life, not a soap opera, so unless you can prove this beyond a shadow of a doubt, congrats, Daddy.

This site is a serious Q&A site. It is not a playground.

To claim that someone recovered your sperm from a used condom and was able to preserve it for two years and then manage to impregnate herself with it is just not credulous.

We don't appreciate making up stories to waste our time.

Hate to say this but I don't see the word condom mentioned in the Op's question. As far as going to court the only thing they can do is request a DNA test that's court approved and go from there based on the outcome.

"stolen ejaculate from a wastebasket" implies a condom. But really this all thing is so farfetched the odds are someone is playing games.

Well, it might not have been stolen after sex with the OP's ex.

Could be the little sister of his current girlfriend or something.

It's pretty far fetched.

Either way--on the off chance that this is a serious question--NO. Whether you exercise your parental rights has nothing to do with whether you're going to be paying child support.

Unless, of course, you can PROVE (like... with hidden cameras or something) that she impregnated herself with your stolen sperm--then you might be able to have HER parental rights taken away on the grounds that she's mentally unstable, and have the child placed for adoption.

A DNA test, in the absence of voluntarily signing an affidavit of paternity, is what affirms or denies legal paternity. If this woman is suing you for child support, you need to have a DNA test done. If it proves you to be the father, then you're liable for paying child support. If it doesn't, then c'est la vie. How the actual pregnancy came about, etc. is inconsequential details. Frankly, this story is so far fetched no judge would ever even consider buying 1/10 into it. I don't buy it and I'm not even a judge.

Tell them the story and they will laugh at you more than we have been,
1. the sperm in the condom may have been used within a very very short time ( hours) it could not have been years latter.

And even if it was, you had sex with them, your sperm, so most likely you still pay child support.

Good luck with the research. If a DNA test proves you to be the father then you will be liable for support unless, like I said, you can prove that the sperm was "stolen" and inseminated. Have you even been to court for the judge to order a DNA test yet? If not wait till the results come back to make up a bunch of off the wall stories about why you shouldn't be held liable for your actions.
