View Full Version : Sold truck next day needed repair

My husband sold a 1984 truck and gave the buyer the title. There was no bill of sale given to the buyer. The check was deposited. The following day they drove the truck and it blew a gasket costing $300.00 to fix. Mechanic notified my husband there was no way he (my husband) would have known the truck had this issue. The buyer is very upset and saying they are taking us to small claims court. My husband offered to pay for $150.00 to fix the truck. The buyer is still upset - confused as to what the right thing to do is.

Basically the used truck was sold as is and the new owner is not happy that he has to part with some $ right after he purchased it. Your husband is not obligated to pay 1/2 or anything for that matter as it is not his truck anymore. The other party will lose in court.

The buyer is most likely blowing smoke. They're upset, which they have a right to be, but they're under the assumption that this is your fault - it's not.
If they are so foolish to file against you, I would see if the mechanic who diagnosed and/or repaired the truck after the sale would be willing to either a)come to court and testify on your behalf, stating that you would not have been able to foresee the issue, or b)write a letter to that same effect and have it notarized. Also bring up in court that your husband offered to split the cost 50/50 but the buyer refused.
