Hi Experts,

I have a situation here.

I entered in MID 2002 in USA.
I am having H1B1 work visa. I supposed to be on job since my 1st day but my consultant as failed to provide me a job.
So I was living by doing ODD jobs.
Now back in sep 2005 I got proper job. Till to date.

My company is also sponsoring me for green card. So I need to provide 3 years tax returns .
Now I need to pay al;l the taxes back years which costing lot of money
I need to know what is the best scenario in this case.
Also if I can file 1040 NR
And what is diff between 1040 and 1040 NR.
Does it will gice me any advantage filing 1040 NR.

Though it is somewhat uncommon for those on a H-1B visa, not filing tax returns for several years happens quite often among U.S. residents.

Since you are on an H-1B visa, you MUST file Form 1040. They specifically ask which visa you are under when you file Form 1040NR or 1040NR-EZ,and they DO cross-check with the Department of Homeland Defense.

How did you get paid for these odd jobs? W-2 or Form 1099-MISC?

If W-2, were income taxes withheld for both federal and state?
