View Full Version : Lying on Emergency Protection Order

I have been feuding with my sister who's husband assaulted me and my husband. My cousin was talked into getting a protective order on me after her boyfriend attempted to run over my 9 year old daughter. She wrote things on there that I can prove are untrue. My parent which raised my cousin can verify that several things she said on the EPO are untrue as well as she told my father she only did it because her boyfriend is getting in trouble for trying to run over my daughter. Is there anything I can do for her lying on the EPO? Also is the EPO going to be on my record? I live in Kentucky.

Protection from abuse orders vary slightly from state to state.

Like in my state if they attempt to contact you even through a third party then THEY violated the PFA and they can get in trouble.

Are they attempting to contact you or still threatening you?

By all means prove they are lying.

I have heard of people getting a counter PFA on the people that got a PFA out on them. That way you would have your side of the story down

You need to read the protective order very carefully. You may be required to give up any guns you may own and may not be allowed to purchase any during the time the order is in effect. Have you had the follow up hearing to put the order into lasting effect ? That's when you can bring up the conflicting stories issue and maybe have it dropped.

Emergency Protective Orders are SHORT term only. Permanent protective orders are NOT given unilaterally. There will be a hearing where BOTH sides will be heard, and a judge will decide.
