I've been living at my apartment for as little as 3 month which I got the apartment through lady whom is the cosigner for that apartment which I stay there under the encounter that I am her sister staying with her but she has gone away... now I am moving out at the end of this month I gave he 3 quarters of the rent already and I owe her 400... We didn't sign no lease and I have not seen her mice I live there because she lives in New Jersey... I've been asking her when am I going to sign the lease and she just give me the run around... so I told her I am leaving at the end of the month because my mother is sick... I ask her for my security deposit; she telling me that she would have to pay 2 times if she breaks the lease and I told her I didn't sign no lease so I need my security deposite because that's my money which imma move our with... Plus the whole 3 month I have to complain about mice problem plus I have a little child... Am I wrong or right

I am not following you enough to understand.
You say the lady is a cosigner then you say it is under the encounter that you are her sister. So does that mean you are just telling people you are sisters?
Who is she cosigning with?
Who is actually renting the apartment in the first place?
What does she mean she will have to pay double?

Hello k:

If you move the damage deposit will go toward the rent that you owe, and the lady who is the co-signer will get sued. Lets hope she's not a friend.

If you don't have a lease, you are a month to month tenant. This means you have to give 30 days notice that you are terminating your tenancy. If she doesn't return your deposit you may have to sue her.
