View Full Version : Realestate lawyer didn't do her job

I purchase a home back in 2004 and now I am trying to sell and the house has more problem than you can image first off I didn't receive the deed until 2006 because it wasn't file until 2/2006 the house as a 1 family and was converted to a 2 family I now find out after doing a survey that a portion of the house is not legally done and need a permit and other work to make it legal also I have no title insurance on my house even though a title insurance fee was charged and on top of that a lien is on the property from the pass owner so please tell me were to go from here and what is the best action to take towards this attorney

It seems like you have two choices; either go back to the first lawyer to see if she will FIX what she broke, or you can hire another lawyer to fix it. Then you'll probably need even another lawyer to sue the first one.

I don't know who dropped the ball here, but how are you damaged?

I don't think title insurance would have protected you from this. You may still have a claim against the previous owner for this.

a lien is on the property from the pass owner...
When was this lien filed? Before you bought the house? Before your deed was recorded? If so, you may have a claim against the attorney or whoever was supposed to get the title insurance. At the time of closing you should have had the title insurance so that you could have demanded the seller to make the lien good.
