Hi,
I was discharged from Bankruptcy in Aug 02. I had insurance for a vehicle that was returned to the leasing company in Jan02. The insurance company from BC is saying that I owe for insurance from Dec-Mar although I disagree with this because I had cancelled with the insurance company and notified them by phone. They have also attached interest to the amount of over 400.00.
I have explained that I contacted the insurance company by phone to cancel the insurance and have a letter from the leasing company indicating that the vehicle was returned dated Feb02. What are the ramifications of not contacting the credit company and not paying the amount. Can they garnish wages and/or sue. I am now currently living in Ontario.
Really appreciate you help.

They have to sue you and win before they can garnish your wages, etc.

Get all your ducks in order for when they sue you. Do you have proof you cancelled the insurance? Show the letter about getting rid of the car, and hopefully you will win your court case.

NEVER, EVER rely solely on a phone conversation to cancel anything.

Send the insurance company a copy of the letter showing the car was turned in. You still owe from Dec to Jan. So offer to pay that.

Thank you for this. I will offer to pay for Dec and Jan as you are suggesting but should I just send the money or send a letter to the insurance company with the offer and wait for an answer.

No, make the offer in writing and see if they accept it.
