My son has just turned 1. His father was around for a little while until I kicked him out almost 2 months ago. Since then he has seen him 3x and 2 of those times was because he was getting his stuff out and the other time was because he saw us walking down the street. He does not put effort into seeing my son. He don't call or anything. The state is taking child support out of his check. He's on all kinds of drugs and is drinking all the time. One time I came home and my son was crying on the floor and I asked him why he wasn't taking care of him, and what was going on. He was on the computer playing a video game and his exact words to me were " its not like i can just put my game on pause" I really need his rights taken away because I'm scared to death that he will try to get custody just to make me mad and get it and my son will not be taken care of. By the way he can't even support himself his mom has to. Do you think I have a good chance of getting his rights taken away? I really need help and fast!

No you don't. What you can do is go to court and ask for custody with him getting supervised visitation (at least for a while).

You have no chance of getting rights taken away unless you are remarried and your spouse wants to adopt. AND dad has to approve. Go back to court as stated above
