Legally you are, unless her husband, not her boyfriend, legally adopts him, AND a judge approves it . You are still responsible for any amount in arrears up to that time.

You need to consult a lawyer.

She cannot MAKE you give up your rights. However, YOU need to start exercising those rights, and keeping up with your OBLIGATIONS.

If you sign over your rights so that her HUSBAND (most states require a marriage of at least a year) can adopt, then you are no longer responsible for child support. You are, however, responsible for back support unless she for some reason waives that as part of the agreement.

I suggest talking to a lawyer.
