View Full Version : Need roommate to leave a.s.a.p he is threating us

We have month-to-month roommate who already got a 30 day certified notice.
He is not in compliance with our verbal agreement since the first day.
All the non compliance things are listed in the notice.
Last night he decided to threat my fiancée who lives in the house. We end up calling the police. A police report was made.
Today he decided to install in his window room a portable a/c unit. This is without check with us. Also he left the house and left the a/c and all light in the house ON.
He keeps sending me text message and e-mails to me insulting ,e such as: I am a moron , etc...
Is there anything else we can do to make him move out a.s.a.p?

I forgot to say that he also left the front door open which caused one of my 2 dogs to scape.
Now I fear for mu dogs, my cat, my fiancée, my brother, myself, and for the house we rent.

You say you gave him a 30 day notice, when does that expire?

Was he arrested or di the police just take a report? Have you tried for a restraining order?

Yes we gave him a certified 30 days notice and will be due on July 3rd.
The police did only a police report.
We are planning to go to the court house tomorrow to do a stalk protective order.
I'm going to take copy of all e-mails and text messages. Also the police report and a copy of the 30 days notice.
Is there anything else I can do?
Please?

At this point your best bet is a restraining order. Youy can then call the police to enforce the order and change the locks afterwards. If he does not move all his belongings, you can set a time for him to come with police escort to remove everything.

Agreed, I see issues with "stalking" on someone that lives in your home. But a order of protection seems like the way to go, if they will issue one.

If not you will have to just wait to the 3rd and do a formal eviction

OK. The drama continues.
As I said before he installed a portable a/c on his room without even ask. I am pretty sure this will make our bill go crazy. Anyway, I decided to go to his room and turn it off. When he come back home he punched my door to argue about the a/c been off. I said he doesn't have the right to do that and that I will take him to the court to pay my bill. He then saw my fiancée and start to offend him saying things such as: you are not a man , etc... Police was called again. Now there is one thing that I did not know. The police did not fill a report. They said they would write information about what happen on their system.
Today me and my brother went to 3 different place and non of them could not do NOTHING. They said by the Law there was not we could do.
I was so !#@%^ that I said to the magistrate that was frustrating to know that the "law" would do something after someone gets physically hurt. After this he decided to tell me that my fiancée could file a police report because he was assaulted. That should be enough to send this guy to jail.
I went to the court also to check if we can do the eviction ( move-out) with 21 days after the official ( certified) 30 days notice but they were not working today.
Any idea about this as well?

If the law says you need to give him 3o days then you need to give him 30 days. If you can get a restraining order you can force him to stay away which is an effective eviction.
