Hello,

I am currently on OPT and my employer is deducting Medicare and Social Security Taxes in error. Apart from my OPT card what other form or document(s) do I need to provide to my employer in order to get the refund.

Get together with the Human Resources department and explain that, as a student under the F-1 visa, you are not liable for Medicare and Social Security taxes and you request a refund of these taxes.

If they refuse to refund it, get the refusal in writing. You can then file Form 843 in January 2007 and ask the IRS to refund these taxes. Download IRS Pub 519 (from www.irs.gov) and read page 42-48 for the process and supporting forms needed.
