My wife had a debt with a credit card company that went unpaid. Our bank account got levied and upon addressing the problem, her check is getting garnished. She has been in garnishment for about 5 months now and this past week, they levied our account for more money on the same Doc#. Can they do this? We already are remedying the account with the garnishment they agreed upon. I tried to speak to the court officer who placed the additional levy and he told me he could levy my account as many times as he wants until the debt is paid. I feel like this is way over board being they are already getting a good chuck of her paycheck. Any advise or actions I can take to keep their hands to themselves?

Thanks

When you say the creditor "filed twice", are you saying that they're garnishing her check AND froze your bank account? If that's the situation, then yes, that's legal.

You might be able to get out of them taking too much money if you can prove that the amount they're taking is placing your income at or below the federal poverty level.

The Froze our account twice. Once when initially. Then they started garnishemnt, then just froze theaccount again the other day for no apparent reseson. Garnishment is already in process and had been for several months

They can freeze your account even though they are garnishing your wife's paycheck. That's legal.

How many times. There was never a problem with the garnishment. They received the agreed amout every two weeks

Until the account is paid off. They can garnish your wages, freeze your account(s), place liens against your personal property... the only way to get them to stop any of that is to pay the account in full.
