HIPAA Question- Colorado...
Medical Dr/Surgeon takes numerous patient X-Rays, CAT scans, MRIs, medical records/ notes, and photos (before and after surgery or botox) and dumps them in piles in the den at HOME. This room is used by everyone in the household. The records and photos are not under lock and key and they are easily accessible to the spouse and teenagers in the home, as well as anyone else in the home. The physician does the same in the family car. Some of the records in the home go back more than 15 years when the physician was even living in another state!
Furthermore, he will show friends, children, and relatives photos of patients on his computer- before and after photos and tell what was done. There is NO need for them to know or to see them.
Do his actions violate HIPAA or any other laws?
What are the potential exposures and penalties for such disregard of patient information and confidentiality? Where will I find the info in the law?
