Recently evicted a tenant and sued for eviction and damages (my mistake) was only allowed to ask for past due rent. Tried to take tenant to small claims for rest of damages and was dismissed (now she can pay a lawyer) and now the lawyer has done a motion to pay attorney fees when the tenant hasn't even paid us the judgement for our court costs of $360.00 from last August. Is there any way for me to answer this motion? The tenant stuck us for about $4000 in damages and because I am not a lawyer now I am in this prediciment. HELP!!

Get a lawyer! If your tennt has one, you need one of your own. If you go up against another lawyer without your own legal repsresentation you are likely to lose.

Not sure where they are at, but here you can't use a lawyer in small claims court?? Unless you are a company. But that was the reason for small claims
But why can't you sue for damages, of course you can, if it is over the small claims limit, sue for damages up to that limit or move to the other court
