You don't file for abandonment, you file for child support. And you should have done that as soon as you got out of the hospital, but yes, tomorrow, go file for support.

If you are 16 with a 2 month old, its possible you started having sex while 15. This means you might be able to charge the father with statutory rape.

As for abandonment, this is a often misunderstood concept. In most states child abandonment is a criminal charge when a child is left without any adult supervision. This is not the situation in your case. Abandonment may be used as grounds for a different action, but its rarely used in child custody issues. Also its too soon to use it any case.

As Steve noted you should be filing against the father for child support. If you are concerned about the father trying to kidnap the child, then you need to formalize custody in court. File for full legal and physical custody. Request no or supervised visitation.
