View Full Version : My child is going to College in a different State then what happens with CS?

I Live in Maryland and my child was born here as well, 17 yrs ago. The mother just up and left after my daughter was about a yr old, and moved to Florida. She has been living there for all this time now. When she turns 18, my child support is going to stop, cause she will have graduated high school by this time. Anyway my question is, Can my daughter's mother still get child support from me if she starts college in Florida? What are the laws concerning College when I, the father paying support, has lived in MD all my life, and have a daughter who is living in Florida, since the age of 1-2 yrs old? Thanks for any info on this please.

If the Court Order says support stops at age 18, that's when it stops.
There is a possibility that the mother could request an extension but you would have to be served.

Which state is the support order from? That's state's laws on termination of support jurisdiction will control, absent an agreement approved by the court to the contrary.

The court order is from Maryland, but she lives in Florida now, and is supposed to be graduating next school yr from HS. She is going to College I'm sure of , in Florida. So it doesn't really matter what Md law says? Can she have it where Florida can make me still pay CS for her going to college there?
I'm sorry but I don't understand those terms that you used when you responded. Lol. Could you define that for me...

If the Court Order is from one State but the person lives in another the law where the Order was GRANTED prevails, not the State where the person LIVES.
And if the Court Order says you pay until age X it will not be changed unless you try to get it changed and I doubt the original Order will be modified. The decision on support was made some time ago for reasons known to the Court and I don't see the question being revisited.

The Maryland child support order controls. It doesn't matter where the child lives, goes to school/college, whatever. In other words, don't worry about it.
