My husband recently received a claim for retail theft of which he is not guilty but still got accused and fired for because of. They are asking us to settle outside of court and pay $350. We are wondering if we settle will it still tarnish his work record.

Are the police or the courts involved at this point and time.
What evidence do they have

We are wondering if we settle will it still tarnish his work record.Hello H:
YES!! NOBODY pays back stuff they DIDN'T steal. If he does, it's an admission. Tell them to SUE.

If we pay the $350 then we are admitting guilt, is that what you are saying? No court or police are involved at this point. However he did sign some kind of paper before he left the store. They are saying however that if we don't pay that we may be called to court.

Ahhhh, you didn't say that before. If they sue him, they'll WIN. Like I said, innocent people don't admit they stole.

Do they have cameras and Loss Prevention at the location your husband worked?

Ok, so he signed a confession before he left they store it sounds like, so he is guilty, since he confessed to it.
And a bad reference from this place when people check on his work record will be a bad record
** a lot more than just a tranish, down right muddy it

If he signed then he was admitting guilt, I would settle. Does he have anyone in the store that will not mention this if a prospective employer calls? Friends that worked with him?
